Protection of servicemen's rights

A serviceman does not lose their civil rights, and gains special guarantees on top of them. Experience shows that without a persistent legal position, some of those guarantees stay on paper.

When to get in touch

• leave you are entitled to is not being granted
• a transfer to another unit is needed and there are grounds for it
• a serviceman is missing or is being held captive
• a family needs guarantees and payments arranged
• disciplinary proceedings are under way

What the lawyer does

• analyses the situation and identifies which guarantees apply
• prepares formal applications on leave, transfer and other service matters
• challenges refusals and inaction on the part of the command
• supports families: status, payments, dealings with state authorities
• prepares applications concerning the search for missing persons
• defends servicemen in disciplinary proceedings

Legal basis

Military service is governed by the Law of Ukraine “On Military Duty and Military Service” No. 2232-XII. Social and legal guarantees are set out in the Law of Ukraine “On Social and Legal Protection of Servicemen and Members of Their Families”; questions concerning missing persons are governed by the Law of Ukraine “On the Legal Status of Persons Missing in Special Circumstances”.

Frequently asked questions

Can a lawyer act without the serviceman being present?

Yes. Under a power of attorney or an engagement, the lawyer represents the client’s interests, including while the person is deployed.

Where should the family of a missing serviceman start?

With having the status recorded and applying to the bodies designated by law; the lawyer handles the procedure and the arrangement of guarantees for the family.
