Reservation of employees liable for military service

Reservation allows a business to keep its key employees. It is also a procedure with strict requirements: critically important enterprise status, quotas, deadlines and grounds for cancellation. Mistakes can cost the whole workforce its reservation.

Legal basis

The purpose and organisation of reservation are set out in Articles 24 and 25 of the Law of Ukraine “On Mobilisation Preparation and Mobilisation” No. 3543-XII; persons liable for military service who are covered by reservation are not called up during mobilisation (Article 23 of that Law). The reservation procedure and the criteria for critically important enterprises are set out in resolutions of the Cabinet of Ministers of Ukraine.

Frequently asked questions

Can an employee arrange reservation for themselves?

No. Reservation is arranged by the employer in respect of its own employees, under the established procedure.

Is reservation permanent?

No. It runs for a limited period and depends on the company keeping its status and on the grounds remaining valid; if those are lost, the reservation is cancelled.
