Immigration matters and citizenship

Immigration cases are primarily a matter of documents and deadlines. A refusal by the authority is not the end of it: most decisions can be challenged in the administrative court.

Legal basis

Decisions, acts and omissions of the migration authorities are challenged under administrative court procedure: jurisdiction is governed by Article 19 of the Code of Administrative Procedure of Ukraine, the available remedies by Article 5, and the burden of proving lawfulness rests on the public authority (part two of Article 77). Citizenship, the legal status of foreign nationals and immigration are governed by special laws of Ukraine.

Can a refusal by the migration service be challenged?

Yes. The decision is challenged in the administrative court, and the authority then has to prove that its refusal was lawful.

How long do I have to go to court?

The general filing period under Article 122 of the Code of Administrative Procedure applies unless a special law provides otherwise — which we check in every case.
