Challenging a notice of suspicion

A notice of suspicion changes a person’s procedural status and opens the way to preventive measures and to the seizure of assets. That is why both the content of the document and the way it was served deserve close legal scrutiny.

When to get in touch

  • you have been served with a written notice of suspicion
  • the notice was served improperly or by a person without authority
  • the wording of the suspicion does not clearly describe the circumstances
  • a preventive measure or seizure of assets has been initiated after service

What the lawyer does

  • analyses the content of the notice and whether it meets the requirements of the Code
  • checks the authority of the person who drew up and served the document
  • assesses whether the circumstances relied on are sufficient
  • prepares and files a complaint with the investigating judge
  • represents the client at the hearing of the complaint
  • agrees the further defence strategy

Legal basis

The cases in which a notice of suspicion is served are set out in Article 276 of the Criminal Procedure Code of Ukraine. Challenging a notice of suspicion falls within Article 303 of the Code and becomes possible once the period fixed by that Article has elapsed.

Legislation and case law are updated over time; this page reflects the position as of August 2026.

Frequently asked questions

When can a notice of suspicion be challenged?

The law ties that possibility to the expiry of a set period running from the date of service. The exact period depends on the category of criminal offence involved.

What does challenging it achieve?

It is the procedural tool for having the investigating judge review whether the suspicion is well founded. The outcome depends on the circumstances of the particular case.
