Defence during the pre-trial investigation

The pre-trial investigation is the stage at which the entire body of evidence takes shape. This is where the outcome of the case is largely set, which is why a systematic defence from the outset works better than reacting once the case is already in court.

When to get in touch

  • information about an offence has been entered in the register of pre-trial investigations
  • you are being summoned, or investigative actions and searches are being carried out
  • a notice of suspicion has been served
  • you need representation throughout the investigation, not a one-off consultation

What the lawyer does

  • establishes the client’s procedural status and the scope of their rights
  • builds a defence strategy for the whole investigation stage
  • takes part in investigative (search) actions
  • files motions for actions to be taken in the interests of the defence
  • monitors compliance with the time limits for the investigation
  • prepares the position for disclosure and for trial

Legal basis

The commencement of a pre-trial investigation is governed by Article 214 of the Criminal Procedure Code of Ukraine; the time limits by Article 219. Under martial law, the special rules in Article 615 of the Code apply.

Legislation and case law are updated over time; this page reflects the position as of August 2026.
