Defence upon detention

The first hours after detention are critical. That is when explanations are recorded, procedural documents are drawn up, and the question of applying to the investigating judge is decided. Having a lawyer present from the outset is what keeps the person’s rights from being breached.

When to get in touch

  • you or someone close to you has been detained
  • the detention took place without an investigating judge’s ruling
  • the person is being held but has not been told on what grounds
  • relatives have not been notified of the detention

What the lawyer does

  • goes without delay to where the detained person is being held
  • establishes the grounds for detention and the person’s procedural status
  • secures a confidential meeting before the first questioning
  • checks the detention record and enters objections
  • makes sure relatives and, where relevant, consular offices have been notified
  • prepares the position for the hearing on the preventive measure

Legal basis

The grounds and procedure for detention are set out in Articles 207 and 208 of the Criminal Procedure Code of Ukraine; the period of detention without a judge’s ruling is limited by Article 211; notification of others about the detention is governed by Article 213.
