A trademark is an asset that only works once it is registered. An unregistered sign is hard to protect from copying, and sometimes the brand owner turns out to be the infringer.

Legal basis
A trademark is defined by Article 492 of the Civil Code of Ukraine; the acquisition of rights is evidenced by a certificate (Article 494); the economic rights in a trademark are set out in Article 495; those rights are valid for ten years from the filing date unless the law provides otherwise, and may be renewed (Article 496). The grounds for invalidating rights are set out in Article 499. The conditions and procedure for issuing the certificate are laid down by special legislation.
