A search is one of the most stressful investigative actions there is. What the defence does in the first few minutes shapes everything that follows: what is recorded, what is actually taken away, and whether the admissibility of that evidence can be challenged later.
When to get in touch
- officers have arrived at a home, office, warehouse or vehicle with a search ruling
- investigative actions are being carried out without a ruling, on grounds of urgency

What the lawyer does

Legal basis
A search is conducted under the procedure laid down in Articles 234 and 236 of the Criminal Procedure Code of Ukraine; the general requirements for investigative (search) actions are set out in Article 223 of the Code.

Frequently asked questions
Can officers be refused entry to the premises?
A search based on an investigating judge’s ruling is carried out regardless of the person’s consent. The lawyer’s task is not to obstruct the action but to keep it within the limits set by the ruling and by law.
Am I entitled to a lawyer during a search?
Yes. The right to legal assistance is fundamental and applies at every stage of the proceedings.
What happens to the property that was seized?
Temporarily seized property is dealt with under the procedure set out in the Criminal Procedure Code; the lawyer prepares the relevant motions and complaints.
