Legal basis
The right to a defence is guaranteed by Article 20 of the Criminal Procedure Code of Ukraine; the procedure for instructing defence counsel is set out in Article 48 and the cases in which counsel is mandatory in Article 52. Searches are governed by Articles 234 and 236, and detention by Articles 207, 208, 211 and 213.
