Access to the case materials

Disclosure is the moment when the defence first sees the full body of evidence that has been gathered. How thoroughly it is worked through determines the line of defence at trial.

When to get in touch

  • the prosecution has given notice that the pre-trial investigation is complete
  • you need to review the case materials
  • the materials have not been disclosed in full
  • you need more time to work through a large volume of documents

What the lawyer does

  • gives effect to the right to review the case materials
  • records the scope of what has actually been disclosed
  • analyses the evidence gathered for relevance and admissibility
  • files motions for full disclosure of the materials
  • prepares a motion for an adequate period in which to review them
  • forms the defence position before the trial begins

Legal basis

The procedure for disclosing materials to the other party is set out in Article 290 of the Criminal Procedure Code of Ukraine.

Legislation and case law are updated over time; this page reflects the position as of August 2026.

Frequently asked questions

What if not everything has been disclosed?

The defence files the appropriate motions; the consequences of non-disclosure are set out in the Criminal Procedure Code and affect whether the evidence can be used at all.

How much time is given for review?

The period must be adequate; where the volume is large, the defence sets out why it needs to be extended.
