Domains and online infringement

Online infringement needs a fast response: the evidence has to be preserved while the page still exists. Then comes the choice of tool — a pre-action demand, an approach to the registrar, or court.

When to get in touch

  • your brand is being used in someone else’s domain name
  • content or products are being copied on third-party sites
  • an infringement needs to be preserved as evidence for court
  • a complaint about content on your own site has arrived

What the lawyer does

  • preserves the infringement properly so it can be proved
  • identifies the infringer and the owner of the resource
  • prepares cease-and-desist demands to the infringer and to intermediaries
  • handles domain disputes, including under the international procedures
  • prepares the claim for protection of intellectual property rights
  • advises site owners on reducing their exposure

Legal basis

The grounds for protecting copyright and related rights, including in the digital environment, are set out in Article 53 of the Law of Ukraine “On Copyright and Related Rights”. Rights in a trademark and their protection are governed by Articles 495 and 499 of the Civil Code of Ukraine; the general remedies for intellectual property rights by Article 432.

Legislation and case law are updated over time; this page reflects the position as of August 2026.

Frequently asked questions

How is online infringement preserved as evidence?

The content of the page has to be properly recorded as at a given date; we arrange that so the evidence is admissible in court.

Can a domain be transferred by force?

That depends on the basis for using the sign and on the procedure chosen — the national courts or the international domain dispute procedure.
