Legal basis
Disputes about decisions, acts and omissions of public authorities in land relations are heard under administrative court procedure: jurisdiction under Article 19 of the Code of Administrative Procedure of Ukraine, remedies under Article 5; the burden of proving lawfulness rests on the public authority (part two of Article 77). Land relations are governed by the Land Code of Ukraine and special legislation; disputes about title may fall within civil or commercial jurisdiction.
Legislation and case law are updated over time; this page reflects the position as of August 2026.
Frequently asked questions
Why are land disputes sometimes not heard by the administrative court?
Where the substance of the dispute is a right to property rather than an exercise of public power, the case may fall within civil or commercial jurisdiction; we determine that at the outset.
Can the revocation of a decision allocating a plot be challenged?
Yes, such a decision can be challenged, and the authority has to prove that it was lawful.
